How To Enter
You may enter the contest by submitting your video or photos to the Canada’s Naughtiest Dog Contest as follows:
Click on the ENTER NOW button on the right side of your screen and follow the on screen instructions. You can either select to submit a video submission or submit a photo and a story of no more than 200 words illustrating why you think your dog should be named the naughtiest in Canada. You must click the box that confirms you agree to all the terms and conditions of the contest.
Entries can be polished, edited masterpieces, or rough cuts. They must, however, be your videos or photos, not just something you "found" on the internet. Give us a couple days to review your submission. If it meets our criteria, your submission will appear live on www.canadasnaughtiestdog.ca. It is solely your responsibility to ensure that your video is properly registered as described above. Bark Busters will not be responsible for any lost, delayed, misdirected, illegible, incomplete, damaged or undeliverable entries, or any delay or failure to transmit, process, receive or consider entries. Bark Busters may remove your submission at Bark Busters sole discretion, without any notice to you.
Submission Guidelines
Your video or photos must meet all of the following criteria to be eligible for the contest:
It must be primarily focused on recording your dog’s naughty behaviour.
It must not contain, depict or refer to any act that could be construed as cruel, inhumane, crude, vulgar, obscene, sexually explicit, disparaging, discriminatory, offensive, illegal or otherwise unsuitable language, activity or other content (all as determined by Bark Busters in its sole discretion).
It must demonstrate and represent respect for the animal and for a safe and responsible approach to animal care. The dog must not be entrapped or set up to behave badly. The video must be a true representation of a legitimate behaviour issue. The video must not contain, depict or refer to any irresponsible behaviour, foolish risks, or harm to any animal (all as determined by Bark Busters in its sole discretion).
It must not contain, depict or refer to any content which disparages or refers negatively to Bark Busters, the contest, or any other person or entity (all as determined by Bark Busters in its sole discretion).
It must not conflict with any of Bark Busters’ core values, or otherwise be objectionable to Bark Busters (as determined by Bark Busters in its sole discretion).
It must not contain any content that violates any law or any third party's rights (including privacy, personality and intellectual property rights).
It must not promote, depict or refer to any commercial enterprises. Nor should it contain URLs or logos laid over the video footage or photo.
Your video or photos may be in colour or black and white, and may be enhanced with graphics, special effects or animation.
Bark Busters may disqualify any entry if Bark Busters determines (in its sole discretion) that the entry does not comply with these eligibility requirements or otherwise with these rules. Bark Busters may remove your submission at Bark Busters sole discretion, without any notice to you.
The video must meet the technical specifications required for it to be uploaded to, and received by the contest web site at www.canadasnaughtiestdog.ca by the end of the contest period.
Contest Eligibility:
To be selected as a finalist and be eligible for prizes, you must be a legal resident of the region in Canada in which you have entered. For instance, if you entered in the British Columbia region, you must be a resident of British Columbia. This contest is not open to residents of the Yukon, Northwest Territories, or Nunavut, or Quebec.
You must own the material you're submitting, and be able to provide written consent from any person that is featured in your video.
How to Win
Step one: GET VOTES and become a finalist
In order to have a chance to win, you need to encourage get as many people to vote for your entry as possible. The five entries with the highest number of votes in each of the four regions will be named regional finalists. You can do this by encouraging anyone to visit www.canadasnaughtiestdog.ca, find your entry and click the vote button.
Voting is open to anyone. In order to vote, you need to register /create a Strutta Account. Each person can only vote once for a specific entry. Users may vote for as many different videos as they choose. If Bark Busters discovers that an individual has voted more than once for the same entry, Bark Busters may disqualify some or all of that individual's votes in Bark Busters' sole discretion.
Voting will end on or around August 1, 2009 at 5pm Pacific time. The 5 submissions from each region with the most votes at the end of the voting period will each be selected as one of the 20 contest finalists. If a finalist submission in a particular activity category is disqualified or deemed ineligible by Bark Busters, that video will not be considered for a prize, and the finalists from that region will be the remaining submissions in that region, plus the submission in that region with the next-highest number of votes (e.g., if one of the top 5 submissions from a region is disqualified, then the sixth-highest submission from that region will become a finalist). Once all 25 finalists have been identified, Bark Busters will notify the finalists of their finalist status, and will post the 25 finalist submissions on the contest website (Bark Busters expects to do so on or around August 11, 2009).
Step 2: Be chosen by the Panel of Judges
The contest's judges will select the winners from the 20 finalist videos. The judges' decisions will be based on:
• the severity of the problem,
• the desperation of the dog owner,
• and the owner’s desire to change the dog’s behaviour.
• They will also consider the ability of behaviour related training to have a positive impact on the dog’s problems. For instance, if the dog’s naughty behaviour is related to a medical or physiological condition, that contestant may not be judged suitable to win.
Bark Busters will select the judges in its sole discretion
The judging will be completed by September 29, 2009. Decisions of the contest judges will be final and binding.
There will be one winner chosen from each of these geographic areas:
• British Columbia
• Prairies (Alberta, Saskatchewan, Manitoba)
• Ontario
• Atlantic Canada (New Brunswick, Nova Scotia, PEI, Newfoundland and Labrador).
From the pool of regional winners, the overall National winner of Canada’s Naughtiest Dog will be chosen.
Winners
The entrants of the winner in each region will be notified by email. In order for these finalists to be declared contest winners and be eligible for a prize, each finalist must have complied with, and remain in compliance with, these rules, and must sign and deliver to BARK BUSTERS (within five days of Bark Busters’ request) a standard declaration and release form (which will include a declaration of the finalists' compliance with these rules, an acceptance of the prize as awarded, a publicity release, a liability release, and the correct answer to a skill-testing question) and any other documentation that Bark Busters may require.
The grand prize winner will be selected by the judges from the 4 regional winners. The Grand prize winner will only receive the grand prize and will not be eligible to receive both the regional winner prize and the grand prize.
Bark Busters may request valid proof of identity, residency, age and other relevant documentation, and Bark Busters may disqualify a finalist if Bark Busters determines (in its sole discretion) that the provided proof is not sufficient.
If the prize notification is returned as undeliverable, or if a selected finalist does not comply with all of the above requirements within the above time frames, or does not otherwise comply with these rules, the finalist will be disqualified and the contest judges will select a replacement finalist.
The chances of winning will depend upon the number of entrants.
Bark Busters expects to announce the names of the winners on or around September 29, 2009.
Prizes
There are four (4) prizes with a total approximate retail value of CAD $4000.
Regional Winners: One Winner will be selected from each of the following five regions:
1. British Columbia
2. Prairies (Alberta, Saskatchewan, Manitoba)
3. Ontario
4. Atlantic Canada (New Brunswick, Nova Scotia, PEI, Newfoundland and Labrador).
Regional Winner Prizes: Regional winners are entitled to Bark Busters In Home Dog training service, complete with our Written Life time Guarantee. In addition, Bark Busters will donate $250 on the winner’s behalf to a registered Animal shelter or rescue of their choice. Total estimated value: $795.00
From the regional winners, one contestant will be selected by the judges to be the overall National Grand Prize winner and will be named Canada’s Naughtiest Dog. The National winner will surrender their regional prize and will instead receive the grand prize.
Grand Prize – Canada’s Naughtiest Dog:
The overall National winner is entitled to Bark Busters In Home Dog training service, complete with our Written Life time Guarantee. The winner also receives the opportunity to host a Bark Busters group training session for ten of their friends and their dogs. In addition, Bark Busters will donate $500 on the winner’s behalf to a registered animal shelter or rescue of their choice. Total estimated value: $1495.00
Finalists:
All finalists that are not named as regional or grand prize winners will receive a gift certificate for $100 to be applied to Bark Busters In Home Dog Training.
All prizes must be accepted as awarded (with no substitutions), and may not be sold, transferred, or converted into cash.
Cancellation
If for any reason BARK BUSTERS cannot run the contest as planned (including as a result of bugs, tampering, unauthorized intervention, fraud, technical failures, infection by computer virus or any other cause that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this contest) BARK BUSTERS may cancel, modify, extend or suspend the contest. In that event, Bark Busters may award prizes at random from among the eligible entries received up to the time of the impairment, or award no prizes.
Bark Busters may also disqualify any individual who tampers with or in any way corrupts the entry or voting process, or who attempts to undermine the legitimate operation of the contest by cheating, hacking, deception, or other unfair practices, or by attempting to annoy, abuse, threaten or harass any other entrants or Bark Busters representatives.
License to Bark Busters
By entering a video or photo in the contest, you waive all rights you may have with respect to the video or photo, including all moral rights and rights of personality, publicity or privacy, and you grant to Bark Busters the unrestricted, royalty-free, perpetual, irrevocable, worldwide license (but not the obligation) to use, reproduce, communicate, modify and display the video or photo (in whole or in part) for any purpose without any fee or other form of compensation, and without further notification or permission, including without limitation the following purposes:
reproducing, publishing, communicating and displaying some or all of the video or photo as part of the contest or otherwise;
identifying you by name as the owner of the video or photo;
judging the contest;
displaying the winning entries in the contest; and
for Bark Busters’ advertising purposes, including to advertise the contest, future contests, and Bark Busters’ products and services.
Modifications
You grant to Bark Busters the unlimited right: (i) to edit or modify your submission in any manner, including by adding visual or aural effects or other elements; and (ii) to use, adopt and modify any or all portions of your submission in combination with other materials. When editing or modifying your submission, Bark Busters will use commercially reasonable efforts to maintain the original essence of the video/photo.
Publicity
Except where otherwise prohibited by law, participation in the contest constitutes a winner's consent to Bark Busters’ use of the winner's name, home town and province for promotional purposes without further notification, permission, payment or consideration. The winner must also consent to appear in television interviews, radio interviews, or in newspaper or magazine articles.
Disclaimers, Liability, and Indemnification
Bark Busters does not accept liability for any loss or damage of any videos entered in the contest or for any other loss or damage resulting directly or indirectly from your participation in the contest.
Bark Busters is not responsible for: (1) incorrect or inaccurate transcription of entry information or late, lost, incomplete, misdirected entries, or entries received through impermissible or illegitimate channels; (2) technical failures of any kind, including without limitation the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any service; (4) unauthorized human intervention in any part of the entry process or the contest; (5) electronic or human error which may occur in the administration of the contest or the processing of entries; or (6) any injury or damage to persons or property, including without limitation your computer, which may be caused, directly or indirectly, in whole or in part, from your participation in the contest or from downloading any material from Bark Busters’ website.
Bark Busters will not be liable to you for any indirect, special, consequential, or punitive damages in connection with the contest or these rules.
By participating in this contest, you release and agree to indemnify and hold harmless Bark Busters and its employees, directors, officers, affiliates, agents, judges and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this contest or receipt or use of any prize.
By participating in this contest, you further agree to indemnify and hold harmless Bark Busters and its employees, directors, officers, members, affiliates, agents, judges and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions or losses of any kind (including actual legal fees and expenses) arising from or related to: (a) your failure to comply with any of these rules; (b) any misrepresentation you make under these rules or otherwise to Bark Busters; or (c) your participation in the contest.
Personal Information
You consent to Bark Busters using and disclosing your personal information for the purposes of administering the contest; advertising the contest and any future contests and any of Bark Busters’ products and services; and for the other purposes described in these rules. If Bark Busters uses some or all of your submission for advertising purposes, Bark Busters will only disclose your first name in that advertising unless you consent to Bark Busters also disclosing your last name.

Official Contest Rules
NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
Definitions
In these Official Contest Rules ("Rules"), the following terms have the meanings specified:
- "Administrator" means Strutta Media Inc.;
- "Contest" means the contest specified in the Contest Summary;
- "Contest Facilitators" means, collectively, the Administrator, the Organizer and any sponsors arranged by the Organizer;
- "Contest Summary" means the contest summary page for a particular contest, which specifies certain information for that contest;
- "Contest Requirements" means the guidelines and criteria that entrants must abide by to be eligible for the Contest.
- "Organizer" means the organization that organizes a contest, as specified in the Contest Summary;
- "Region" means the region(s) selected in which the Contest is held.
1. Eligibility: The Contest is FREE to enter and open to all individuals, who are legal residents of the Region(s) specified and have reached the legal age of majority in your Region of residence at the time of Your Entry, or if a minor (at the time of Your Entry, you have your parent’s or legal guardian’s knowledge and consent to enter; ("you" or "Contestant"). The officers and directors of the Organizer and Administrator ("the Contest Facilitators") as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, officer and director are not eligible. The Contest is void outside the Region specified and where prohibited by applicable federal, state, provincial or local laws, rules or regulations.
2. Agreement to Official Rules: By participating in the Contest, entrant fully and unconditionally agrees to and accepts these Rules and the decisions of the Organizer and/or Administrator, which are final and binding in all matters related to the Contest. Whether or not you receive a prize is contingent upon fulfilling all requirements set forth in these Rules. The Contest is subject to all applicable federal, state, and local laws. The Organizer is responsible for ensuring the contest complies with all laws in all jurisdictions where the Contest is offered.
3. Contest Period: The Contest opens on the date and time specified in the Contest Summary, and ends on the date and time specified in the Contest Summary (the "Contest Period"). All times specified are Pacific Standard Time (PST). The Administrator’s computer is the official time-keeping device for the contest.
4. How to Enter: To enter the Contest, you must create a Strutta account and complete the registration form (the "Registration Form") online with your email address, password and any required questions as specified by the Contest Facilitators. You must then provide an entry ("Entry") during the Contest Period that fulfills the contest requirements ("Contest Requirements") and any guidelines as specified in the Contest Summary to be eligible to win a Prize. Entries that do not include all the required information and adhere to the Rules will be considered void. The Contest Facilitators are not responsible for lost, misdirected or incomplete Entries.
The Organizer determines if an entry meets the Contest Requirements and otherwise complies with the Rules.
5. Terms of Submission: You may enter the Contest as many times as is specified in the Contest Summary. You may delete your Entry at anytime. By participating in the Contest you permit public voting in connection with Your Entry.
6. Rights Granted by you: By entering this Contest, you agree to the following:
- the Contest Facilitators and their licensees, successors and assigns will have the right to use all or a part of Your Entry, your name and address (city and state/province/territory), and the names, likenesses, photographs, voices and images of all persons appearing in the Entry, for future advertising, trade, promotion and publicity in any manner and in any medium now known or hereafter devised throughout the world in perpetuity, without compensation and without notice to you and without consideration, review or approval from you.
- You agree that you will not now nor in the future be paid for Your Entry or for granting the Contest Facilitators any of the rights set out in these Rules.
7. YOUR REPRESENTATIONS AND WARRANTIES
By entering the Contest, you represent and warrant that:
- Your Entry, in its entirety, is an original work by You and you have not included third party content (such as writing, poetry, text, graphics, artwork, logos, photographs, likeness of any third party, musical recordings, clips of videos, television programs or motion pictures) in or in connection with Your Entry without permission;
- Your Entry, the use thereof by the Contest Facilitators, or the exercise by the Organizer or Administrator of any of the rights granted by you under these Contest Rules, does not and will not infringe or violate any rights of any third party or entity, including, without limitation, patent, copyright, trademark, trade secret, defamation, privacy, publicity, false light, misappropriation, intentional or negligent infliction of emotional distress, confidentiality, or any contractual or other rights;
- you have all the rights, licenses, permissions and consents necessary to submit the Entry and to grant all of the rights that you have granted to the Contest Facilitators under these Contest Rules;
- all persons who were engaged by you to work on the Entry, who appear in the Entry in any manner, or have contributed to the Entry have:
- given you their written consent to submit the Entry without claims for payment of any kind.
- provided written permission to include their name, likenesses, image or pictures in or with Your Entry (or if a minor who is not your child, you must have the permission of their parent or legal guardian) and you may be asked by the Contest Facilitators to provide such permission in writing to the Contest Facilitators;
- you have read, understood, accept and agree to be bound by the Administrator’s Terms of Use set out at http://www.strutta.com/terms-of-service, as they may be amended from time to time
8. Prizes: The Organizer will provide the prize or prizes (if there are multiple prizes) to be awarded for a particular contest, and such prizes are specified in the Contest Summary ("Prize" or "Prizes", as the case may be). No substitution of a Prize will be made unless the Organizer, in its sole discretion, determines otherwise. A Prize must be accepted as awarded, and the odds of winning are dependant upon the total number of eligible entries received for the Contest Period.
9. Winner(s): The winner(s) ("Winner(s)") of the Prize(s) will be selected as specified in the Contest Summary, from all eligible entries received. If you are selected as a Winner, you will be notified of the selection of your entry by the phone or email address provided by you on the Registration Form. If you do not respond to the phone or email notification of your selection as a Winner within three (3) days, an alternate Winner will be selected to receive the Prize.
10. To Redeem Prize: Except where prohibited, a Winner (or his/her parent/legal guardian if the Winner is a minor in his/her jurisdiction of residence) will be required to execute and return to the Organizer within ten (7) days of the date notice or attempted notice is sent, an Eligibility, Liability & Publicity Release Form in order to claim the Prize. A Prize is personal to the Winner and is non-transferable. If a Winner cannot be contacted, or fails to execute and return the Affidavit within the required time period (if applicable), or if the Prize is returned as undeliverable, the Winner forfeits the Prize. Acceptance of any Prize shall constitute and signify the Winner's agreement and consent that the Contest Facilitators may use the Winner's name, city, state, likeness, Entry and Prize information in connection with the Contest, worldwide, including on the Internet, without limitation and without further payment or consideration, except where prohibited by law. Each Winner (or his/her parent/guardian if the Winner is a minor) is responsible for all taxes and fees associated with receipt of the Prize.
11. Voting: Online voting begins and ends as stated in the Contest Summary (the "Voting Period"). Anyone who registers on http://www.strutta.com can vote for their favorite Entry or the Entry that best meets the judging criteria during the Voting Period. The Contest Facilitators have the right, in their sole discretion, to maintain the integrity of the Contest, including the right to void votes, including, but not limited to, the following reasons:
- Multiple votes from the same user from different IP addresses or from different email addresses;
- Fraudulent entry votes (using a redirect link, a disguised link, a fraudulent link, etc.);
- Technical malfunction of servers or internet connection;
- User(s) recanting their own votes;
- Technical or content upgrades that render votes incompatible or inconsistent;
- Inappropriate conduct in promoting votes (spam, harassment, etc.).
12. General Conditions: The Contest Facilitators have the right to verify your eligibility and compliance with these Contest Rules, and to disqualify you on the basis of its investigation.
Your personal data will be processed in accordance with the Administrator’s Privacy Policy, as set out at http://www.strutta.com/privacy-policy. You should direct any request to access, update, or correct your personal information to Administrator.
You may not enter with multiple e-mail and/or street addresses, nor may you use any other device or artifice to submit more than one (1) Entry or vote. If you use fraudulent Entry methods, or otherwise attempt to participate with multiple e-mail and/or street addresses under multiple identities, or use any device or artifice to enter more than one (1) Entry, you will be disqualified. In the event of a dispute as to any Entry, the authorized account holder of the e-mail address used to enter will be deemed to be the person who made the Entry. For the purposes of these Rules, the authorized "account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.
Nothing contained in these Rules shall be construed to: (i) give any Party the power to direct and control the day-to-day activities of the other; (ii) constitute the Parties as partners, joint venturers, principal and agent, employer and employee, co-owners or entrants in a joint undertaking; or (iii) allow you to create or assume any obligation on behalf of the Organizer.
By entering the Contest, you fully and unconditionally agree to and accept these Rules and the decisions of the Organizer and the members of the voting community, which are final and binding on all matters relating to this Contest.
13. Liability Provisions: The Contest Facilitators are not responsible for human error, theft, destruction, or damage to Entries or other factors beyond its reasonable control.
You assume all risk of damaged, lost, late, incomplete, invalid, incorrect or misdirected Entries. The Contest Facilitators makes no warranty, representation or guarantee, express or implied, in connection with its ability to in any way enable, develop or market the idea set forth in Your Entry.
The Contest Facilitators shall not be liable to a winner or any other person for failure to supply the Prize or any part thereof, by reason of the Prize becoming for reasons beyond the reasonable control of the Contest Facilitators unavailable or impracticable to award, or for any force majeure event, technical or equipment failure, terrorist acts, labor dispute, or act/omission of any kind (whether legal or illegal), transportation interruption, civil disturbance, or any other cause similar or dissimilar beyond the Organizer’s control. The Organizer, Administrator and their employees, officers, directors, agents, contractors, representatives, affiliates, divisions, subsidiaries, resellers, dealers, distributors, advertising/promotion agencies (the "Released Parties") shall not assume any responsibility whatsoever for any of the following: delayed, failed, partial or garbled computer transmissions; technical failures of any kind, including, but not limited to, lost, interrupted or unavailable network, server, Internet Service Provider (ISP), the Site or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines or technical failures or difficulties; the incorrect or inaccurate capture or failure to capture information whether caused by Site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest, Submission, or other information; the failure to capture any such information; or errors of any kind whether human, mechanical, electronic, network or otherwise arising out of or relating to the Contest, theft, loss, destruction or damage to the Entry in whole or in part, or other factors beyond their reasonable control. The Released Parties are not responsible for injury or damage to your or to any other person’s computer related to or resulting from participating in the Contest or downloading materials from or use of the Site.
CAUTION: ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE THE SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF APPLICABLE CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, THE ORGANIZER AND ADMINISTRATOR RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW AND TO DISQUALIFY YOU FROM THE CONTEST.
LIMITATIONS OF LIABILITY AND RELEASE: BY SUBMITTING AN ENTRY, YOU AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE RELEASED AND HELD HARMLESS BY YOU AND YOUR HEIRS, EXECUTORS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS FOR ANY CLAIMS, LIABILITIES, OR CAUSES OF ACTION OF ANY KIND OR NATURE FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES TO PERSONS, INCLUDING, WITHOUT LIMITATION, DISABILITY OR DEATH, AND DAMAGE TO PROPERTY, DUE IN WHOLE OR IN PART, ARISING DIRECTLY OR INDIRECTLY, NOW OR IN THE FUTURE FROM THE DELIVERY, ACCEPTANCE, USE OR MISUSE OF THE PRIZE, ANY AND ALL USE AS PROVIDED HEREIN OF YOUR ENTRY, OR PARTICIPATION IN THIS CONTEST AND/OR ANY RELATED ACTIVITY. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, IN WHICH CASE SUCH LIMITATION OR EXCLUSION SHALL APPLY ONLY TO THE EXTENT PERMITTED BY THE LAW IN THE RELEVANT JURISDICTION.
14. Choice of Law: These Rules shall be governed by and construed in accordance with the laws of the Province of British Columbia, and the laws of Canada, as applicable herein, without reference to its conflicts of laws principles. Any and all disputes, claims, and causes of action with the Contest Facilitators arising out of or connected with this Contest, other than the determination or validity of claims, shall be resolved individually, and exclusively by arbitration under the British Columbia International Commercial Arbitration Centre, in accordance with its rules, as amended from time to time. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest, but in no event attorneys’ fees. You hereby waive all rights to: (i) claim or be awarded any punitive, direct, indirect, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses; and (ii) to have damages multiplied or otherwise increased.
